Why score the risk before you sign?

Redevelopment is one of the biggest financial decisions a society ever makes, yet most committees judge an offer on the headline area and corpus alone. The problems that actually derail projects — a disputed title, a builder with no track record, a guarantee that is too small, a Development Agreement that was never registered — are easy to miss in the excitement of a good-looking proposal. This checker turns those risks into a simple, weighted score so your committee can see, at a glance, how exposed the deal is and what needs fixing first. It draws on the same factors experienced advisors look for: legal ownership, disputes, the state of the plot, and the strength of the developer and the agreement.

What are the three kinds of risk it checks?

  • Legal & title — conveyance, land disputes and disputes between members or tenants.
  • Plot & premises — unauthorised structures, FSI already consumed, road width and location.
  • Developer & agreement — RERA registration, bank guarantee, registered DA and PAAA, track record, timeline, corpus and rent, conflict of interest, and an independent PMC.

Common questions

What are the biggest red flags in a redevelopment offer?

The most serious red flags are a disputed or unconveyed land title, a developer who is not registered with MahaRERA, no or a weak bank guarantee, and a Development Agreement or PAAA that is not registered. Plot issues such as unauthorised construction, more than 2.0 FSI already consumed, a road narrower than 18 metres, and a weak location reduce what the project can deliver. A conflict of interest between the committee and the developer, an unrealistic timeline with no penalty, and no independent project management consultant are also warning signs.

Should the developer be RERA-registered?

Yes. Under the Real Estate (Regulation and Development) Act, 2016, most redevelopment projects must be registered with MahaRERA, and the Government of Maharashtra's 4 July 2019 directive under Section 79A expects societies to deal with a MahaRERA-registered developer. Registration gives you a public record of the project, an escrow requirement for buyers' money, and a forum for complaints. Always verify the registration number on the MahaRERA website before you sign.

What protects a society if the builder delays or abandons the project?

Your main protections are a bank guarantee, a registered Development Agreement and Permanent Alternate Accommodation Agreement with clear timelines and penalties, continued transit rent until possession, and dealing with a financially sound, RERA-registered developer with a track record. The 4 July 2019 directive expects a bank guarantee of around 20 percent and completion within about two years. If a builder still defaults, the society can act on the guarantee and, in serious cases, terminate the agreement and pursue legal remedies.
