How does the committee arrive at a fair rent figure?
Start from evidence, not from what a neighbouring society settled for years ago. Ask what a flat of similar carpet area actually rents for today within reasonable distance of your building — the same catchment members will realistically shift to. What clauses must sit alongside the number?
Three things belong in the tender beside the rent figure:
- Escalation. Construction takes years and rents rise. An annual escalation clause should be stated in the tender, not left to be negotiated later.
- Rent until possession. Say plainly that rent, brokerage and shifting charges continue until members actually take possession — not until the promised completion date. The Government of Maharashtra directive dated 4 July 2019 (No. SGY-2018-PK 85-14-S) expects completion in about two years and a bank guarantee of around 20 per cent; both support this clause.
- Payment schedule. State whether rent is paid monthly, quarterly or in advance, and what follows if it is delayed.
Why does a low tender figure hurt every member?

Should the tender state a fixed rent or invite developers to quote their own?
State a minimum figure. If you leave rent open, bids arrive at widely different levels and become hard to compare fairly. A stated floor, backed by real local rent evidence, keeps every offer on the same footing and lets the committee compare the rest of the package — corpus, extra carpet area and timelines — on merit.
Is annual escalation of transit rent standard in Mumbai redevelopment?
An annual escalation clause is commonly included, because construction runs over several years and market rents do not stay still. The exact percentage varies by project and locality, so it is negotiated rather than fixed by any regulation. Write your expectation into the tender itself so bidders price it in from the very start.
What if the developer stops paying rent before possession?
This is why the tender should tie rent to actual possession, and why the bank guarantee of around 20 per cent referred to in the Government of Maharashtra directive dated 4 July 2019 matters. The registered Development Agreement should record the rent obligation, the escalation and the consequences of default clearly before any member vacates.
